Terms of Service

EFFECTIVE DATE: July 1, 2026

    Please read these Terms of Service ("Terms") carefully before using  StudyPanel. By downloading, installing, accessing, or using the StudyPanel  mobile application (the "App") you agree to be bound by these Terms. If you  do not agree, do not use the App.

    1. ELIGIBILITY

    You must be at least eighteen (18) years old to use the App. The App is  designed for adults capable of entering into binding contracts. If you are  under 18, you must not use the App. Individual studies listed in the App  may set their own age, health, geographic, or other eligibility criteria;  you are solely responsible for confirming your eligibility before applying  to any study.

    2. WHAT STUDYPANEL IS AND IS NOT

    StudyPanel is an information-discovery tool. We aggregate publicly  available listings of paid research studies, focus groups, clinical  trials, surveys, and interviews from third-party sources (including  ClinicalTrials.gov and other public directories) and present them in a  searchable interface.

    StudyPanel is NOT:
    (a) an organizer, sponsor, employer, or medical provider for any study  listed in the App;
    (b) a party to any agreement between you and the researcher, sponsor, or  company operating a study;
    (c) a broker or agent for compensation, and we do not pay users for  participation in any study;
    (d) a medical, legal, financial, or professional advisor. Nothing in the  App constitutes medical, legal, financial, or professional advice.

    Every study is operated by a third party. StudyPanel does not screen,  vet, endorse, or verify the safety, legality, methodology, compensation,  or outcome of any listed study. Any interaction, application, screening,  payment, or participation is strictly between you and that third party.

    3. NO GUARANTEES

    Study listings are provided "AS IS" and "AS AVAILABLE." StudyPanel makes  no representation or warranty about the accuracy, completeness,  timeliness, availability, safety, or legitimacy of any listing.  Compensation amounts, eligibility criteria, availability, and schedules  are set by the study operators and change without notice. StudyPanel does  not guarantee that you will qualify for, be accepted into, complete, or  be paid for any study.

    4. HEALTH AND SAFETY DISCLAIMER

    Some listings describe medical or clinical research that may involve  experimental treatments, drugs, devices, procedures, blood draws,  imaging, or other health-related activities and carry health risks.  StudyPanel is not a medical provider and does not evaluate the safety of  any study. Before applying to or participating in any medical study you  must consult your own physician, read the study's own informed-consent  documents, and independently verify the study operator's credentials.  You participate at your own risk.

    Nothing in the App is intended to diagnose, treat, cure, or prevent any  disease. Do not rely on the App for medical advice.

    5. NEVER PAY TO JOIN A STUDY

    Legitimate research studies do not require participants to pay to  participate. If a listing or the party operating a listing asks you to  pay a fee to participate, submit payment information beyond what is  needed to receive compensation, share your bank login, or transfer money,  STOP and report the listing to jakub.zitko@icloud.com. This is a common  signature of a scam.

    6. USER RESPONSIBILITIES

    You agree that you will:
    (a) provide accurate information about yourself in your profile;
    (b) use the App only for lawful, personal, non-commercial purposes;
    (c) not scrape, resell, or redistribute study listings;
    (d) not attempt to reverse engineer, tamper with, or interfere with the  App or its servers;
    (e) not use the App to impersonate any person or misrepresent your  identity or eligibility;
    (f) comply with the terms of any third-party study you apply to.

    You are solely responsible for your interactions with any study operator,  including the accuracy of the information you submit to them, the  confidentiality of any data you share, and the outcome of your  participation.

    7. SUBSCRIPTIONS AND AUTO-RENEWAL

    Certain features of the App require a paid subscription ("StudyPanel Pro").  Subscriptions are sold as auto-renewing subscriptions through the Apple  App Store.

    - Payment is charged to your Apple ID at confirmation of purchase.
    - Your subscription automatically renews at the end of the current period  at the then-current renewal price unless you cancel at least 24 hours  before the end of the current period.
    - You can manage or cancel your subscription in your Apple ID account  settings at any time. Deleting the App does not cancel your subscription.
    - Any free trial period, if offered, will convert into a paid  subscription automatically unless cancelled at least 24 hours before the  trial ends. Any unused portion of a free trial is forfeited when you  purchase a subscription.
    - Refunds are handled by Apple in accordance with Apple's Media Services  Terms and Conditions. StudyPanel does not process refunds directly.

    Prices, features, and product availability may change. Any material  changes will apply only to renewals occurring after the change is made  public.

    8. INTELLECTUAL PROPERTY

    The App, including all software, design, text, graphics, logos, and  compiled listings, is owned by StudyPanel and its licensors and is  protected by copyright, trademark, and other laws. We grant you a  limited, revocable, non-exclusive, non-transferable, non-sublicensable  license to use the App on Apple-branded devices you own or control,  solely for personal, non-commercial use, in accordance with these Terms  and Apple's Usage Rules.

    9. THIRD-PARTY CONTENT AND LINKS

    The App may display links to third-party websites, contact information,  or application pages operated by study organizers. StudyPanel does not  control and is not responsible for the content, policies, security, or  availability of any third-party site or service. Your use of any third  party is at your own risk and subject to that third party's terms and  privacy policies.

    10. DISCLAIMER OF WARRANTIES

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL CONTENT ARE  PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND,  WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT  LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A  PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, OR AVAILABILITY.  STUDYPANEL DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-  FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT  ANY LISTING OR CONTENT IS ACCURATE, RELIABLE, OR LEGITIMATE.

    11. LIMITATION OF LIABILITY

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL STUDYPANEL,  ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE  LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY,  OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS,  REVENUE, DATA, BUSINESS OPPORTUNITY, GOODWILL, MEDICAL EXPENSES, OR  PERSONAL INJURY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY  TO USE THE APP OR PARTICIPATION IN ANY STUDY, WHETHER BASED ON  CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER  LEGAL THEORY, EVEN IF STUDYPANEL HAS BEEN ADVISED OF THE POSSIBILITY OF  SUCH DAMAGES.

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUDYPANEL'S AGGREGATE LIABILITY  ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL  NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO STUDYPANEL IN THE 12  MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B)  ONE HUNDRED U.S. DOLLARS (USD $100).

    Some jurisdictions do not allow the exclusion or limitation of certain  damages, so the above may not apply to you in whole or in part.

    12. INDEMNIFICATION

    You agree to defend, indemnify, and hold harmless StudyPanel and its  affiliates, officers, directors, employees, and agents from and against  any and all claims, demands, actions, liabilities, damages, losses,  costs, and expenses (including reasonable attorneys' fees) arising out  of or related to (a) your use of the App, (b) your participation in or  application to any listed study, (c) your violation of these Terms or  of any applicable law, or (d) your violation of the rights of any third  party.

    13. TERMINATION

    We may suspend or terminate your access to the App at any time, with or  without notice, for any reason, including if we believe you have  violated these Terms. You may stop using the App at any time. Sections  that by their nature should survive termination (including  intellectual property, disclaimers, limitations of liability,  indemnification, and dispute resolution) will survive.

    14. GOVERNING LAW; DISPUTE RESOLUTION; ARBITRATION

    These Terms are governed by the laws of the State of Delaware, USA,  without regard to conflict-of-law principles. Any dispute arising out of  or relating to these Terms or your use of the App shall be resolved  exclusively through final and binding individual arbitration  administered by the American Arbitration Association under its  Consumer Arbitration Rules. Arbitration will take place in Delaware or  another mutually agreed location, or by videoconference. Judgment on  any arbitration award may be entered in any court of competent  jurisdiction.

    YOU AGREE THAT YOU AND STUDYPANEL MAY BRING CLAIMS AGAINST EACH OTHER  ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS  MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. YOU AND  STUDYPANEL EACH WAIVE ANY RIGHT TO A JURY TRIAL.

    Nothing in this section prevents either party from seeking injunctive  or equitable relief in court for infringement of intellectual property  or misuse of confidential information. You may opt out of arbitration  by sending written notice to jakub.zitko@icloud.com within 30 days of first  accepting these Terms.

    15. APPLE-SPECIFIC TERMS

    You acknowledge that these Terms are between you and StudyPanel, and  not with Apple Inc. ("Apple"). Apple has no obligation to furnish any  maintenance and support services with respect to the App. Apple is a  third-party beneficiary of these Terms and, upon your acceptance, will  have the right (and will be deemed to have accepted the right) to  enforce these Terms against you as a third-party beneficiary. You  represent that you are not located in a country that is subject to a  U.S. Government embargo and are not listed on any U.S. Government list  of prohibited or restricted parties.

    16. CHANGES TO THESE TERMS

    We may update these Terms from time to time. Material changes will be  posted in the App and take effect on the date noted at the top of the  updated Terms. Continued use of the App after the effective date  constitutes acceptance of the updated Terms. If you do not agree, stop  using the App.

    17. SEVERABILITY; ENTIRE AGREEMENT

    If any provision of these Terms is held unenforceable, the remaining  provisions will remain in full force and effect. These Terms, together  with the Privacy Policy, constitute the entire agreement between you  and StudyPanel regarding the App and supersede any prior agreements.
